Terms of Service

This page states the terms of service (the “Terms of Service”) under which you may use IDSHK.ORG (the “Web

Site”) of INDUSTRIAL DESIGNERS SOCIETY of HONG KONG (the “Company”). The Company provides its

services to you, subject to the following Terms of Service. The Company may in its sole discretion revise these

Terms of Service by updating this posting at any time without notice to you, and you are advised to visit this page

periodically to review the most current Terms of Service.

 

1. Use of Materials

The contents of the Web Site, such as text, graphics, images, logos, button icons, links, HTML code, trademarks,

software and other material (collectively, the “Materials”) and the compilation (i.e., the collection, arrangement

and assembly) of all Materials on the Web Site are protected by copyright, trademark and other laws applicable.

All the Materials and the compilation thereof are the exclusive property of the Company or its content suppliers or

clients. Unauthorized use of any of the Materials may violate copyright, trademark, and other laws applicable.

You shall not sell or modify the Materials or copy, reproduce, republish, upload, download, post, transmit, store in

a retrieval system, display, publicly perform, distribute in any way, or otherwise use the Materials in any way

without the Company’s prior written consent and for any public or commercial purpose.

 

2. Copyright

The works posted on the Web Site are submitted by third parties, including visitors of the Web Site, who have

declared that the works are created by themselves. The Company is not in a position to verify this, and as such

makes no warranty, express or implied, for the works with respect to their completeness, merchantability, fitness

for purposes, non-infringement of intellectual property rights, or being free of viruses. Under no circumstances will

the Company be liable to any person for any loss or damage arising directly or indirectly from or in connection

with the works posted on the Web Site. INDUSTRIAL DESIGNERS SOCIETY of HONG KONG may in its sole

discretion take any action against these.

 

3. Copyright Complaints

The Company respects the intellectual property of others. If you believe that your work has been copied and

posted on the Web Site in a way that constitutes copyright infringement, you may email us the complaint at

info@IDSHK.ORG

 

4. Use of the Web Site

You shall not submit, post, upload or otherwise transmit to the Web Site or the Company any work or contents

that infringes any intellectual property rights, or is unlawful, defamatory, or otherwise objectionable. Unless

having obtained prior written permission from the Company, no one shall reproduce, duplicate, copy, sell, resell

or otherwise exploit the Web Site or any portion thereof for any commercial purpose. The Company reserves the

right to, without any prior notice, limit your access to the Web Site, or suspend the service or terminate your

account, which shall be made by the Company in its sole discretion and the Company shall not be liable to you or

any third party for the suspension of service or termination of account.

5. Your Registration Obligations

In consideration of your registration with the Web Site, you agree to: (a) provide true, accurate, current and

complete information about yourself or your company as prompted by the registration form (such information

being the “Registration Data”) and (b) maintain and promptly update the Registration Data to keep it true,

accurate, current and complete. If any information you provided is untrue, inaccurate, out-dated or incomplete, or

the Company has reasonable grounds to suspect the same, the Company may in its sole discretion suspend or

terminate your account and decline your current or future use of any service of the Company.

 

6. Privacy Policy

Registration Data and certain other information about you are subject to our Privacy Policy.

 

7. Member Account, Password and Security

You will receive a password and account designation upon completing the registration. You are responsible for

maintaining the confidentiality of your password and account, and are fully responsible for all activities that occur

under your password or account. You agree to (a) immediately notify IDSHK.ORG of any unauthorized use of

your password or account or any breach of security, and (b) ensure that you exit from your account at the end of

each session. The Company cannot and will not be liable for any loss or damage arising from your failure to

comply with this section.

 

8. Disclaimer

The Materials may contain inaccuracies or typographical errors. The Company disclaims all implied and/or

express warranties and makes no representations about the accuracy, reliability, completeness, or timeliness of

the Web Site or the Materials. The Company takes no responsibility and assumes no liability for the contents of

the Web Site or for anything posted on or linked to it, including without limitation, any mistake, error, omission,

infringement, defamation, falsehood, or other material or omission that might offend or otherwise give rise to any

claim or complaint. The use of the Web Site and the Materials are at your own risk. Changes are periodically

made to the Web Site and may be made at any time and you are advised to review the Materials from time to

time.

The Web Site is provided by the Company on an “as is” basis. The Company will not be liable for any damages of

any kind arising from the use of the Web Site, including but not limited to direct, indirect, incidental, punitive and

consequential damages.

 

9. Indemnity

You agree to indemnify and hold the Company, and its subsidiaries, affiliates, officers, agents, co-branders or

other partners, and employees, harmless from any claim, proceedings, damages, injuries, liabilities, losses, costs

and expenses (including reasonable attorneys’ fees and disbursements) or arising out of the contents you submit,

post to or transmit through the Service, your use of the Company’s services, your connection to the Web Site,

your violation of the Terms of Service, or your violation of any rights of others.

 

10. Severability

If any one or more of these Terms of Service, or their application in any circumstance, is held invalid, illegal or

unenforceable in any respect for any reason, the validity, legality and enforceability of that term or condition in

any other respect and the remaining Terms of Service shall not in any way be impaired.

 

11. Dealings with Advertisers

Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through

the Web Site, including payment and delivery of related goods or services, and any other terms, conditions,

warranties or representations associated with such dealings, are solely between you and such advertiser. You

agree that the Company shall not be responsible or liable for any loss or damage of any sort incurred as the

result of any such dealings or as the result of the presence of such advertisers on the Web Site.

 

12. Governing Law

The Terms of Service shall be construed in accordance with, and this Agreement is governed by the laws of the

Hong Kong Special Administrative Region, without regard to the Conflict of Laws provisions thereof. You agree

that any claim you might have against the Company shall be bought before the courts of the Hong Kong Special

Administrative Region.
